In order to implement the results of the recent consultations between China and the United States on economic and trade issues, on December 15, the Customs Tariff Commission of the State Council issued an announcement stating that from 12:01 on December 15, 2019, the implementation of the “State Council Customs Tariff Commission on the original Announcement on the Resumption of Tariffs on Automobiles and Parts Produced in the United States. The implementation time will be notified separately.
That is, from 12:01 on December 15, 2019, the “Announcement of the Customs Tariff Commission of the State Council on Suspending Tariffs on Automobiles and Parts Originating in the United States” (Tax Commission Announcement [2018] 10 No.) The 28 tax items listed in Annex 1 will continue to be suspended from the “Announcement of the Customs Tariff Commission of the State Council on Imposing Additional Tariffs on Imported Products Originating in the United States of $50 Billion” (Tax Commission Announcement [2018] No. 5) 25% tariff.
For the 116 tax items listed in Annex 2 of the Tax Commission Announcement [2018] No. 10, the “Announcement of the Customs Tariff Commission of the State Council on Imposing Tariffs on Imported Products Originating in the United States of About 16 Billion Dollars” (tax Commission Announcement [2018] No. 7) to impose a 25% tariff.
For the 67 tax items listed in Annex 3 of the Tax Commission Announcement [2018] No. 10, the “Announcement of the Customs Tariff Commission of the State Council on Imposing Additional Tariffs on Imported Products Originating in the United States of About US$60 Billion” will continue to be suspended ( Tax Commission Announcement [2018] No. 8) imposes an additional 5% tariff.
The announcement also pointed out that from 12:01 on December 15, 2019, the “Announcement of the Customs Tariff Commission of the State Council on Imposing Tariffs on Some Imported Products Originating in the United States (Third Batch)” (Tax Commission Announcement [2019] No. 4) The goods in Annex 2 will not be subject to the tariff increase measures stipulated in the Announcement [2019] No. 4 of the Tax Commission.
That is, for the 749 tax items listed in the first part of Annex 2 of the Tax Commission Announcement [2019] No. 4, and the 163 tax items listed in the second part, the additional levy of the Tax Commission Announcement [2019] No. 4 will not be levied 10% tariff; for the 634 tax items listed in the third part of Annex 2 and the 1815 tax items listed in the fourth part, the additional 5% tariff imposed by the Tax Commission Announcement [2019] No. 4 will not be levied for the time being. The implementation time will be notified separately.
The Customs Tariff Commission of the State Council stated that in addition to the above measures, other tariff measures against the United States and Canada will continue to be implemented in accordance with regulations, and the exclusion of products subject to tariffs on the United States and Canada will continue. China hopes to work together with the US on the basis of equality and mutual respect to properly resolve each other’s core concerns and promote the stable development of China-US economic and trade relations.
