Reply letter on safety supervision and administrative licensing of metal processing enterprises such as calcium and magnesium

Changzhi City Emergency Management Bureau:

Your bureau's "Request for Instructions on Clarifying Matters Concerning Safety Supervision and Administrative Licensing of Calcium, Magnesium and Other Metal Processing Enterprises" (Chang Ying Fa [2023] No. 45) has been received. The reply is as follows:

1. The "Catalogue of Hazardous Chemicals (2015 Edition)" stipulates: "Calcium (metallic calcium), metallic calcium powder, calcium alloy, calcium-manganese-silicon alloy (789~791)", "magnesium, magnesium alloy [sheet Shapes, bands or strips, containing magnesium>50%] (1572~1573)" etc. belong to hazardous chemicals.

2. Article 14 of the "Regulations on the Safety Management of Hazardous Chemicals" (Decree No. 591 of the State Council of the People's Republic of China) stipulates: "Before production of hazardous chemicals, enterprises shall follow the regulations of the "Regulations on Safety Production License" , to obtain a hazardous chemical safety production license". Article 3 of the "Implementation Measures for the Safety Production Permit of Hazardous Chemical Production Enterprises" stipulates: "Enterprises that have not obtained a safety production license shall not engage in the production of hazardous chemicals". (2015 Edition) Implementation Guidelines (Trial)" (General Administration of Work Safety Administration No. 3 [2015] No. 80) Article 3 clarifies: Enterprises sell hazardous chemicals with the same product name in the "Catalogue" after changing the material state , should obtain a hazardous chemical business license.

Please ask your city to punish enterprises for illegal production and processing according to law, and order enterprises to apply for hazardous chemical business licenses according to law.

3. According to the "National Economic Industry Classification" (GB/T4754-2017) and the "Notice of the State Administration of Work Safety on Printing and Distributing the Metal Smelting Catalog (2015 Edition)" (Safety Supervision Four [2015] No. 124), Relevant safety supervision departments implement the safety supervision duties of non-ferrous metal smelting and rolling processing industrial enterprises for such enterprises in accordance with the law.
